Passby terms of service
Effective November 3, 2026
The short version. Passby pings you and a friend when you're close. Add only people who want to be your friend, never use Passby to follow or bother anyone, and don't rely on it for your safety. Your name and photo are yours, and only your friends see them.
These terms are an agreement between you and Passby ("we", "us"), the maker of the Passby app and its server. By ticking "I agree" in the app, or by using Passby, you accept these terms and our privacy policy. If you don't agree, don't use Passby.
1. Who can use Passby
You must be 13 or older. If you are under 18, you need permission from a parent or guardian, and they accept these terms for you. If the law where you live sets a higher age for using an app like this, you must meet that age.
2. Your account
You sign in with Apple or Google. One account is for one person. Keep your phone locked and your sign-in safe, because anyone holding your unlocked phone can use your account. Tell us at support@shawnzhu02.com if you think someone else is using it.
3. Location and your safety
- Friends you add can see that you are near them, and roughly where, while you are both in range. You control this with ghost mode, stealth zones and your radar size, and by removing friends.
- Passby is not a safety, emergency or tracking service. Pings can be late, missed or wrong, for example when your phone is offline, low on battery, or has location turned off. Never rely on Passby to find someone or to keep anyone safe. In an emergency, call your local emergency number.
- Use good sense when you meet people. Meet in public, and remove anyone you stop trusting.
4. Rules
When you use Passby, you agree not to:
- add someone as a friend without their agreement, or share another person's friend code to get them added;
- stalk, harass, threaten or intimidate anyone, or use Passby to follow or keep track of someone who doesn't want that;
- pretend to be someone else;
- use a name or photo that is sexual, violent, hateful, harassing, or that you don't have the right to use;
- use a modified app, script or other tool to work out other people's locations, or to get around ghost mode, stealth zones or radar sizes;
- overload, attack, probe or break into our server, or reverse-engineer it to harm other users;
- use Passby for anything illegal.
5. Your name and photo
- The name and profile photo you add are yours. You let your friends' Passby apps show them to those friends, and nobody else. Your phone encrypts your photo for each friend, so we can't see it.
- Passby has zero tolerance for objectionable or abusive content and behavior. Because we can't see names or photos, you are responsible for what you share.
- Removing a friend blocks them. They lose your photo and can no longer see when you are near, straight away.
- To report a person or content, write to support@shawnzhu02.com. We act on reports within 24 hours. We can close the account of anyone who breaks these rules.
6. Price, Passby+ and changes
Passby is free to use. Passby+ is an optional yearly subscription that raises your friend limit and adds a supporter badge and extra map and pin looks. Ghost mode, stealth zones and every other privacy control stay free for everyone.
- Apple handles payment. The app shows the price before you buy, and Apple charges your Apple ID.
- Passby+ renews every year at the same price unless you turn off auto-renew at least 24 hours before the current year ends. Manage or cancel it in your Apple ID's subscription settings, or from Settings in Passby.
- Deleting your Passby account does not cancel the subscription. Cancel it with Apple first.
- Tips are one-time payments that unlock nothing.
- Refunds for Passby+ and tips follow Apple's rules and go through Apple.
Passby is still early. We may change features, put limits on the service, or stop it, with notice in the app where we can. We may suspend or close an account that breaks these terms or puts other people at risk. You can stop using Passby at any time, and delete your account in Settings.
7. Our software
We let you use the Passby app on devices you own or control, for your own personal use. Passby's name, design and code belong to us or to their licensors. Some parts of Passby are open-source software under their own licenses.
8. No warranty
Passby is provided "as is" and "as available". As far as the law allows, we make no promises about Passby, including that it will work without interruption or errors, that pings will arrive, or that it fits a particular purpose.
9. Limit of liability
As far as the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost data or profits, coming from your use of Passby, from other users' behavior, or from pings that arrive late or not at all. Our total liability to you for any claim about Passby is limited to the greater of what you paid us in the 12 months before the claim and US $50. Some places don't allow these limits, and then they apply only as far as the law there allows.
10. Law and disputes
These terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict-of-law rules. Disputes go to the state or federal courts in Massachusetts, unless the law where you live gives you the right to bring them in your local courts. Please write to us first, since most problems can be fixed by email.
11. Changes to these terms
If we change these terms, the new version appears here with a new date, and the app asks you to accept it before you keep using Passby.
12. If you got Passby from the App Store
These extra terms apply when you use Passby on an Apple device:
- This agreement is between you and Passby only, not Apple. Passby, not Apple, is responsible for the app and its content.
- Your license to use the app is limited to Apple-branded devices you own or control, as the App Store's Usage Rules allow.
- Apple has no duty to provide maintenance or support for Passby.
- If Passby fails to meet any warranty that applies, you can tell Apple, and Apple will refund the purchase price, if any. As far as the law allows, Apple has no other warranty duty for Passby.
- Passby, not Apple, handles any claim about the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
- If someone claims that Passby infringes their intellectual property, Passby, not Apple, is responsible for dealing with that claim.
- You confirm that you are not in a country under a US government embargo or named as a "terrorist supporting" country, and that you are not on a US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms, and can enforce them against you.
